All bunkers supplied by charterers to be in conformity with the following specifications.
Type/viscosity of fuel is used for main propulsion: Ifo 380cst RMG max sulfur 0.5% as per ISO 8217: 2010 spec Type/viscosity of fuel is used in the generating plant: MGO LS DMA (max sulfur 0.1%) Quality of the bunkers to be always within ISO 8217,2010 full specs. In the unlikely event that in some areas/ports same is not actually possible then Quality of the bunkers to be within ISO 8217, 2005 full specs, but said specs to be always suitable for the vessel and subject to the owners previous consent who in such case will be advised in advance about the intended bunkers’ specs which are to be supplied for their final check/approval. Bunkers must be homogeneous and stable, free of polypropylene,wasted oils, luboils,residues from acid slops and sludges, must also be free of any other chemicals or substances which can damage marine engines and/or marine boilers and/or auxiliaries or any other related equipment. Important Notes Regarding Vessel’s «Speed / Consumption Description» ===================================================================
* While ballasting/deballasting during cargo operations in port or at sea, or while exchanging ballast water, vessel burns about 2.50 mt additional IFO. Also while at sea, vessel burns additional 0.35 mt MGO for auxiliary machinery (e.g. incinerator). Owners’ liberty vessel to burn diesel oil when maneuvering/approaching and leaving ports/navigating in canals/rivers or congested/ confined/ shallow waters whatsoever or in cold weather for boiler/heating.
** Speed & consumption warrantee is given in good weather conditions only and no adverse currents or other factors whatsoever affecting vessel’s speed, always provided vessel’s hull is not heavily fouled and load line is not exceeding her Summer DWAT/Draft. Good weather conditions are understood to mean winds of up to and including Beaufort 04 and/or Douglas sea state 03 (3 to 5 feet significant wave height).
*** About is understood to mean 0.5 knts downwards in the speed and 5% upwards in the consumption.
**** Slow Steaming as per above options ‘a’ or ‘b’ is not allowed during vsl’s passage (if any) through piracy areas and same to be declared in writting by charterers directly to the master with copy to owners managers’ office otherwise vsl’s original speed/cons at sea to apply. Where the Charterers give instructions to the Master to adjust the speed or RPM, the Master shall, subject always to the Master’s obligations in respect of the safety of the Vessel, crew and cargo and the protection of the marine environment, comply with such written instructions, provided that the engine(s) continue(s) to operate above the cut-out point of the Vessel’s engine (s) auxiliary blower (s) and that such instructions will not result in the Vessel’s engine(s) and/or equipment operating outside the manufacturers’/designers’ recommendations as published from time to time.
Vessel’s Performance Evaluation ===============================
It is hereby agreed that for performance evaluation purposes, the overall performance of the vessel under a time charter shall be reviewed on overall basis only just before vessel’s redelivery and on the basis of all laden and ballast passages of the charter. Weather periods in excess of Beaufort 4 and/or Douglas sea state 3, are to be expressly excluded from any performance evaluation calculations.
It is also well understood and agreed that Charterers shall have no right to deduct from intermediate hire payments (but only from the last sufficient hire payment (s) after all laden and ballast passages) any amount in respect of any alleged by them, and/or their sub charterers (if any), under performance of the vessel as the vessel’s performance is hereby agreed to be evaluated on overall/aggregate basis on completion of all and any passages under a charter party and always as per relevant provisions of the charter party including but not limited to the vessel’s time charter description as provided herein and Bimco «Evidence of performance» Clause which shall apply and be incorporated in the charter party.

Rightship approval in no event shall constitute a subject and/or condition under this charter party neither on commencement nor during the same.
f) ITF or Similar Cover Notwithstanding anything else agreed under a c/p vessel’s crew and officers shall be ‘ITF’ approved or alternatively in Owners option employed on board under a contract approved by the competent authority of the vessel’s flag whether this contract agreement is fully acceptable to the ‘ITF’ or not
g) Gangway position It is located AFT; notwithstanding anything else agreed under a c/p it is hereby irrevocably and unconditionally agreed that in case of aussie trading the charter of the vsl by a charterer shall be deemed as irrevocable acceptance of the vsl’s gangway position by the charterers and owners will not need to make their own inquiries locally or to satisfy themselves to this respect.
